BUFFALO, NY-A mistrial was declared Friday afternoon in the case of a man charged with killing his elderly mother.

Jury deliberations got underway Tuesday afternoon in the case against Primitivo Cruz. Police say Cruz beat, strangled and stabbed his 77-year-old mother, Carol Quinn, in her West Seneca home last spring.

State Supreme Court Justice Penny Wolfgang called for the mistrial after the panel of twelve could not reach a unanimous verdict.

Cruz will remain in custody until he is re-tried in the matter in May.
